True Value D.I.Y. All-Star Contest 1st Home Edition Official Rules
NO PURCHASE NECESSARY
The following Contest is intended for play and participation in the United States only and shall be construed and evaluated only according to the laws of the United States. Please do not enter this Contest unless you are a legal resident of the 50 United States or the District of Columbia and located in the United States at the time of nomination.
Eligibility: Contest is open only to, and both Nominators and Nominees (as defined herein) must be individual legal residents of the 50 United States and the District of Columbia who are at least 18 years of age (an "Eligible Individual"). Void in Puerto Rico and where prohibited or restricted by law. Employees, directors, officers and agents or members of True Value Company ("Sponsor"), individual True Value Store employees, subsidiary companies, sales representatives, advertising and promotion agencies, and members of the immediate families (parent, child, sibling and spouse of each) or households of any of the above are prohibited from entering the Contest. Subject to all federal, state, and local laws and regulations.
How to Enter: Contest begins 12:00:01 a.m. Central Time ("CT") on July 14, 2008 and ends at 11:59:59 p.m. CT on August 22, 2008, ("Contest Period"). To nominate an Eligible Individual (including yourself) who you believe is a "1st Time Do-It-Yourself All-Star" online, visit www.StartRightStartHere.com during the Contest Period and follow the instructions to submit a nomination ("Nomination") including an essay of up to 250 words and up to three (3) photo(s) OR a video not to exceed 5 minutes in length that support and represent the essay (photos must be .jpg format and not to exceed 2MB each in size, video must not exceed 5 minutes in length and must be in an avi, .mov or .wmv format). To be eligible, the person nominated ("Nominee") must be currently living and someone the person submitting the Nomination ("Nominator") personally knows and considers a role model for others in terms of their "first time" home
improvement accomplishments, ability to share their knowledge of home improvement, and willingness to help others with home improvement or other similar reasons. Nominees may not be professional construction workers or repair persons, which include anyone whose income is derived primary from construction or home improvement. Nominations must include an essay up to 250 words in length describing why the Nominee is a "1st Time Do-It-Yourself All-Star" ("Essay") and up to three (3) photograph(s) OR one short video that supports and represent the essay ("Submission(s)"). Acceptable Submission(s) include, but are not limited to, before and after project images, finished do-it-yourself tasks outlined in the submission essay or the Nominee with their proudest 1st time home improvement achievement. Information stated in a Nomination Essay or Submission(s) is subject to verification of Sponsor in its sole discretion. In order to submit a Nomination, Nominator must have permission from Nominee. Sponsor,
in its sole discretion, may require Nominator to verify such permission before naming a Nominee as the Winner. All Essays must be in English. Nominators are entering on behalf of the Nominee named in the Nomination. Nominators who nominate someone other than him/herself are not eligible to receive any prize. Online nominations must be received by August 22, 2008, at 11:59:59 PM CT. Sponsor and/or its agents are not responsible for any inaccurate transcription of entry information, or any failures and/or delays in online transmissions, malfunction or failure of any Internet connection, malfunction or failure of software or hardware, or any other errors or delays in the transmission of receipt of Nominations, whether human or technical in nature. Illegible or incomplete entries are disqualified. Lost, late, misdirected, mutilated, or postage-due entries will not be considered. Submissions(s) and Essays become the exclusive property of Sponsor and will not be returned.
By submitting a Nomination, Nominator represents that the Submission(s) and Essay submitted has never been published, has not previously won any other contest award, use thereof does not infringe third party rights (including those of any photographer), are suitable for publication and the right to submit the Submission(s) or Essay is not restricted by copyright. Nomination cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. Entries not complying with all rules are subject to disqualification. No correspondence regarding entries will be entered into with Nominators. With respect to Submission(s) and Essay entered, Nominator unconditionally assigns and transfers to Sponsor all right, title, interest and claim, including, without limitation, the copyright therein. Sponsor shall have right to use, alter, assign or dispose of such entries however it sees fit without approval of Nominators and Nominator hereby authorizes Sponsor to post the Submission(s) and Essay entered on the Internet for the Second Round of judging portion of this Contest. In order to accept the prize, Nominator will be required to confirm in writing to the Sponsor the right to use Nominator's name, image, likeness and biographical materials, and Submission(s) and Essay, for advertising, publicity and promotion purposes including without limitation online announcements without additional compensation, unless prohibited by law.
Judging of Essays and Photo(s): All Essays and Photo(s) OR Video will be judged by an independent qualified panel of judges, whose decisions are final and binding on all matters relating to this Contest, to select up to twenty Semi-finalists ("Semi-finalists"). All entries (essay and Photo(s) OR Video) will be judged based on the following equally weighted criteria, whether they include 1, 2 or 3 photo(s) OR a Video: (#1) helpful "1st Time Do-It-Yourself" role to others, (#2) relevance to Theme and (#3) "Do-It-Yourself" accomplishments. Photo(s) OR Video will be judged based on how well the Photo(s) OR Video supports and represents why the Nominee is a "1st Time Do-It-Yourself All-Star". The scores for the Essays (75%) and Photo(s) OR Video (25%) will be combined to arrive at a total score for the Nomination. In the event of a tie, tie will be broken based upon the highest score for the Essay in category #1 and continuing thereafter in each category until the tie is broken. In the second round of judging ("Second Round"), Semi-finalists' Photo(s) OR Video and Essays will be posted for public voting at www.StartRightStartHere.com between 12:00:01 a.m. CT September 4, 2008 and 11:59:59 p.m. September 18th, 2008. The public will be asked to vote for the Semi-finalist who best represents the ”1st Time Do-It-Yourself All-Star ” theme. The four (4) Semi-finalists who receive the highest number of votes will be eligible for the Final Round of Judging ("Finalists"). The Grand Prize winner will be determined by Sponsor from among the four Finalists using the same criteria as described above. Grand Prize winner will be notified by telephone, postal mail, express mail and/or e-mail on or about October 1, 2008.
Prize: One (1) Contest Grand Prize: A 2-hour in-person project consultation from Steve Watson, host of HGTV's "Don’t Sweat It," at a site designated by winner in conjunction with Sponsor and up to $5,000 to spend at a True Value store near the winner's residence. Actual time, date and location of consultation are at the discretion of Sponsor and must be used by December 31, 2008. No transfer of prize allowed. No cash redemption or prize substitution allowed, except as provided herein. In case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.
Winner Verification: Potential Contest Grand Prize winner and his/her Nominator will be notified by telephone and/or certified mail and will be required to sign, have notarized and return an unmodified Affidavit of Eligibility and Liability/Publicity release within seven (7) days of issuance in order for Nominee receive the Prize.
If Contest Grand Prize is won by an eligible minor (as determined by his/her state of residence), winner will be required to have parent or legal guardian sign and return applicable documentation. If Contest Grand Prize notification letter or prize is returned as undeliverable, or any prize documentation is not submitted as required by Sponsor, the prize will be forfeited and an alternate will be selected by Sponsor from among the remaining three Finalists.
General: All taxes on all prizes are solely the responsibility of winner. By participating in this promotion, Nominators agree to abide by and be bound by these Official Rules and the decisions of the judges which are final in all matters relating to this promotion. Nominators waive the right to assert as a cost of winning a prize, any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize, or from use, misuse, acceptance or possession of said prize. By participating, Nominators agree, and by accepting a prize, Nominees agree, to release True Value Company, its parent company, affiliates, subsidiaries and agents, including without limitation its advertising and promotion agencies, and each of their respective directors, employees and officers (collectively "Releasees"), from any and all liability arising from or in connection with participation in this promotion, or the awarding, receipt or use of any prize. By entering, Nominators further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Nominator's and Nominees rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois. By entering, Nominators consent to the jurisdiction and venue of the federal, state and local courts located in Illinois.
Limitations of Liability: Sponsor and other Releasees are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of Nominations, whether caused by the sender or any of the equipment or programming associated with or utilized in the Contest; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the nomination process or the Contest; (iv) electronic, clerical or human error which may occur in the administration of the Contest or the transmission, receipt or processing of Nominations or notification of winners; or (v) any injury or damage to persons or property, including but not limited to Nominator's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Nominator’s participation in the Contest. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this Contest if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the Contest. Under no circumstances, including negligence, shall the Sponsor or the other Releasees be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the website, or out of any breach of any warranty or in any other way arising out of or related to this promotion. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR'S WEBSITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Any attempt to deliberately damage any website or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Nominator
engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won by Nominee.
